These Terms & Conditions (“Terms”) govern your use of the website located at www.medicalats.com (the “Site”), which is owned and operated by A T S Medical Supplies Trading L.L.C (“we,” “our,” or “us”). By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you are not authorized to use the Site.

1. Governing Law & Jurisdiction

1.1. Country of Domicile: The United Arab Emirates (“U.A.E.”) is our country of domicile.
1.2. Governing Law: These Terms shall be governed by the laws of the U.A.E.
1.3. Jurisdiction: Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in the U.A.E.

2. Payment Terms

2.1. Accepted Payment Methods: We accept Visa and MasterCard credit and debit cards for payment, provided that such cards are issued in AED (United Arab Emirates Dirham).
2.2. Restricted Transactions: In accordance with U.A.E. law, we will not trade with or provide services to individuals or entities owned or controlled by, or acting for or on behalf of, countries or persons subject to sanctions administered by the Office of Foreign Assets Control (“OFAC”).
2.3. Minor Use: Users under the age of 18 are not permitted to register on or transact through the Site.
2.4. Cardholder Records: Cardholders must retain a copy of their transaction records, as well as any applicable merchant policies and rules.

3. User Responsibilities

3.1. Account Confidentiality: Users are responsible for maintaining the confidentiality of their accounts, including usernames and passwords, and for all activities that occur under their account.
3.2. Accuracy of Orders: Users must ensure all information provided when placing orders is accurate. Once an order is confirmed, users are responsible for any cancellations or modifications as outlined herein.

4. Cancellation Policy

4.1. No Cancellations After Confirmation: Once an order is confirmed and processed, cancellations are not permitted. Please review your order carefully prior to submission.

5. Order Changes

5.1. Modifications: Orders cannot be modified once confirmed. If you wish to cancel or return an item, please refer to our Return & Refund Policy below.

6. Items Not Received

6.1. Shipping Control: Once an item has been shipped, we no longer have control over it.
6.2. Tracking & Carrier Contact: If an order is marked as delivered but not received, please contact the shipping carrier directly for further information.
6.3. Persistent Issues: For ongoing concerns, contact us at [email protected]. In cases where tracking details are unavailable due to technical issues, please also reach out to us at [email protected] for support.
6.4. Lost or Damaged Items: For items reported lost or damaged, please see our Return & Refund Policy below.

7. Refund Policy

7.1. No Refunds: Refunds are not provided once an order is placed and paid for. Certain products may be explicitly identified as non-returnable and non-refundable at the time of purchase.

8. Return & Refund Policy

8.1. General Policy: Returns and refunds are not accepted once an order is placed, except under the limited circumstances described below.
8.2. Discretionary Support: If you change your mind after placing the order, you may email [email protected] to request assistance. Any support offered in such cases shall be at our sole discretion.
8.3. Conditions for Return:

  • The item is defective, damaged, incorrect, or non-functional.
  • For items with a manufacturer seal, the seal must be intact and unopened.
  • The product must be returned in its original packaging, with all accessories included.
    8.4. Return Authorization Required: You must contact us at [email protected] and receive authorization before returning any item. Unapproved returns will not be accepted.
    8.5. Return Shipping & Costs:
  • If you change your mind, you must return the product in its original condition at your own cost and risk, following our instructions.
  • If the product has already been processed for delivery, do not unpack it upon receipt. Send it back using the instructions we provide.
  • Returns must be shipped within 7 days of receiving our instructions, and you must provide the return courier tracking number immediately.

9. Delivery & Shipping Policy

9.1. Scope: These terms apply to all shipments originating from A T S Medical Supplies Trading L.L.C.
9.2. Shipping Charges:

  • Within Dubai: A standard shipping fee of 30 AED.
  • Other Emirates: A standard shipping fee of 45 AED.
  • International: Shipping costs vary based on sea or air freight. Actual rates will be communicated during the order process.
    9.3. Delivery Timeframes: Estimated shipping and delivery dates are provided for convenience only. We are not liable for any delays.
    9.4. Shipment Confirmation & Tracking: You will receive an email confirmation containing your tracking number(s) once your order has shipped. Tracking typically becomes active within 24 hours.

10. Lost Shipments

10.1. Contact Us: If your package has not arrived within two (2) days after the expected delivery date, please email us at [email protected].
10.2. Investigation Period: We will investigate the matter with the courier, which may require 3–5 business days.
10.3. Resolution: If the shipment cannot be located after our investigation, it will be deemed lost. You will then be offered either a full refund or a replacement, at your discretion.

11. Limitation of Liability

11.1. No Liability for Certain Damages: We shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of the Site or products purchased therefrom.
11.2. Maximum Liability: In no event shall our total liability exceed the amount paid by you for the specific product in question.

12. Amendments

12.1. Right to Amend: We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting to the Site. Your continued use of the Site after any such modifications constitutes acceptance of the amended Terms.

14. PURCHASING TERMS AND CONDITIONS

A T S Medical Supplies Trading L.L.C values quality suppliers and gives preference to suppliers with ISO 9001 or other relevant quality management certification. These Purchasing Terms and Conditions (“Purchasing Terms”) apply to suppliers of goods and services to A T S Medical Supplies Trading L.L.C and are subject to our ISO 9001 Quality Management System certification.

  1. Changes to Approvals
    • Upon acceptance of any order, suppliers shall notify A T S Medical Supplies Trading L.L.C of any changes to approvals held from all third parties.
  1. Notification of Product or Process Changes
    • The supplier shall immediately notify A T S Medical Supplies Trading L.L.C of any changes to product, process, facility, or documentation applicable to the relevant purchase.
  1. Non-Conforming Parts or Materials
    • The supplier must promptly contain and notify A T S Medical Supplies Trading L.L.C of any parts or materials believed to be non-conforming, and agree upon an appropriate disposition. This requirement extends to any non-conforming parts already delivered.
  1. Order Amendments
    • Suppliers must not accept any verbal or written order amendments unless such amendments are signed by an authorized purchasing representative of A T S Medical Supplies Trading L.L.C.
  1. Right to Verify at Source
    • The quality assurance representatives of A T S Medical Supplies Trading L.L.C, its customers, and relevant regulatory authorities reserve the right to verify at the supplier’s facility that the purchased materials or products conform to order requirements.
  1. Quality Records
    • Quality records that relate to product conformity and/or process control, including statistical results, shall be:
      • Effectively archived.
      • Readily retrievable and made available upon request.
      • Not destroyed without prior written consent from A T S Medical Supplies Trading L.L.C.
  1. Sub-Tier Suppliers
    • Sub-tier suppliers shall not be used without prior arrangement with A T S Medical Supplies Trading L.L.C.
    • Process substantiation shall be made available upon request.
    • The supplier shall flow down the requirements of the purchase order and associated specifications to any sub-tier suppliers, as applicable.
  1. ISO 9001 QMS & Related Requirements
    • A T S Medical Supplies Trading L.L.C operates within an ISO 9001 Quality Management System (“QMS”) framework. This includes, but is not limited to:
      • Internal and external approval requirements for products and services, methods, processes, and product/service release.
      • Providing services and manufacturing parts in a controlled manner, ensuring personnel competency and management of external service providers.
      • Communicating test and inspection processes, along with QMS requirements, to ensure parts are produced with adequate control and traceability.
      • Training staff to recognize and prevent the use of counterfeit parts, and to uphold legal, ethical, and moral standards in service provision.
  1. Documentation and Delivery
    • Goods must be accompanied by a delivery note and a Certificate of Conformity (“C of C”), as applicable.
    • No partial delivery shall be accepted without prior written arrangement.
  1. Payment Terms
  • Unless otherwise agreed in writing, payment terms are Net 60 days from the end of the invoice month.
